Overcoming The Complexity Of Military Family Law

The divorce process is made even more complex if one or both spouses are members of the United States Army, Marines, Air Force, Navy or any other branch of the military.

At the Law Office of Michael L. Seidman, we are no stranger to the complexities of family law in California, and we pair our more than 35 years of legal experience with extensive military experience. Founding lawyer Michael L. Seidman served in the United States Navy Reserves and was on active duty from 1967 through 1970 during the Vietnam conflict.

Protection For Members Of The Military

The Servicemembers Civil Relief Act provides protection for members of the military in family law matters. That protection is focused primarily on active duty military members, who are not able to participate in divorce proceedings. For these military members, exceptions to the general family law rules can be made. Whether a person is stationed in the U.S. or overseas, proceedings may be postponed until the person is off active duty.

Not A Standard Divorce

Whether you are in the military or your spouse is in the military, it is important to understand that there are unique differences between your divorce and other peoples’ divorces. Those differences can pertain to child custody and visitation, child support and more.

One of the key differences is the division of military retirement benefits. Rules such as those contained in the Uniformed Services Former Spouses Protection Act (USFSPA) dictate what types of benefits can be divided and how they are to be divided upon divorce. This is an issue that needs to be handled carefully, due to the significant amount of retirement pay military personnel may receive. We understand how to handle this and all other matters related to military divorce.
